Salem 13 Terms of Service

· Effective date

These Terms of Service ("Terms") govern your use of the Salem 13 app (the "App"), published by The Willows Designs LLC ("The Willows," "we," "us"). By downloading the App, creating an account, or otherwise using it, you agree to these Terms. If you don't agree, don't use the App.

The App and the Salem 13 Challenge

Salem 13 is a paid, GPS-based scavenger game. After downloading the App, you can start a Salem 13 attempt: a 72-hour window in which you check in at 13 historic Salem, MA locations by visiting each one in person and confirming your location through the App. Each location earns points toward a total of 1,500. Completing all 13 locations within the window earns a completion reward, described further under "Prizes and Rewards" below.

Eligibility and Accounts

You must create an account to use most features of the App. You agree to provide accurate information, keep your login credentials confidential, and accept responsibility for activity that happens under your account. You must meet the App's minimum age requirement to create an account, consistent with the age requirement in our Privacy Policy.

Business and Artist Listings

Business and Artist accounts require a paid subscription. Submitting a listing does not guarantee it appears publicly: every listing is reviewed and must be manually approved by The Willows before it becomes visible in the App. You are responsible for the accuracy, legality, and appropriateness of everything you submit — including your bio, photos, offer details, and any linked social media accounts. The Willows may deny, suspend, or remove a listing at its discretion, including after approval, for example if it violates these Terms or contains false or infringing content.

User Conduct

When using the App, you agree not to:

  • Falsify your GPS location or otherwise attempt to spoof, fake, or manipulate a check-in
  • Impersonate another person or misrepresent your affiliation with a business or organization
  • Submit unlawful, infringing, or fraudulent content in a Business or Artist listing
  • Interfere with the App's normal operation or attempt to access accounts or data that aren't yours

Salem 13 involves visiting real, physical locations. You are responsible for your own safety: obey traffic laws, respect private property, and use good judgment. You participate at your own risk.

User Content and Reporting

You retain ownership of the content you submit (such as a Business or Artist listing's bio and photos), but by submitting it you grant The Willows a license to display, store, and distribute it within the App. If you see a listing or other content that violates these Terms, you can report it in the App. The Willows may review, edit the visibility of, or remove content, and may suspend or terminate accounts, that violate these Terms.

Prizes and Rewards

Completing all 13 Salem 13 locations within a single 72-hour attempt window earns a one-time completion reward, redeemable at the currently featured partner business. The reward code is personal to your account, is not transferable or exchangeable for cash, and must be redeemed within 30 days of completion or it expires. Redemption is subject to the featured business's own availability and offer terms. The Willows may change the featured reward, its terms, or discontinue the reward program at any time, and is not responsible for a featured business's failure to honor a redemption.

If you earn more than one completion reward within the same 30-day window, they cannot be combined or stacked into a single redemption — each must be redeemed separately, one at a time.

Payments and Subscriptions

The App is a one-time paid download, billed through the Apple App Store or Google Play at the time of purchase. Business and Artist listing subscriptions are billed on a recurring basis through the app store or in-app purchase system you signed up with. You can manage or cancel a subscription anytime through your app store account settings; canceling stops future billing but does not refund the current period. Fees are generally non-refundable except as required by law or by Apple's or Google's own refund policies.

Disclaimers

The App is provided "as is" and "as available." We don't guarantee that GPS check-ins will always work precisely, that the App will be free of interruptions or errors, or that any featured business offer will remain available. Salem 13 sends you to real, physical locations in Salem, MA; The Willows is not responsible for conditions at those locations, including traffic, weather, terrain, or the actions of third parties.

Limitation of Liability

To the fullest extent permitted by law, The Willows Designs LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid to us in the 12 months before the claim arose.

Termination

We may suspend or terminate your account if you violate these Terms, including GPS spoofing, fraudulent Business or Artist listings, or abusive conduct. You may delete your account at any time from your profile settings, as described in our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. The "Effective date" at the top will reflect the most recent revision, and we will notify you in the App of any material changes before they take effect. Continued use of the App after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
